ANALYTICAL DIAGNOSIS OF THE ENVIRONMENTAL LICENSING PROCESS IN THE BRAZILIAN SCOPE

With the growth of space granted to environmental issues, one of the most notorious tools disseminated in the management of natural resources is the Environmental Licensing activity. Especially in the Brazilian scenario, it represents a sector with great challenges and potential, the first of which is justified by the premise of decentralization of licensing competences and non-acceptance by the sectors related to capital, since they see it as an obstacle for the development of activities in general. On the other hand, the potentials are guided in developing the activities in an environmentally sustainable and correct way, aiming to minimize the environmental impacts that the anthropic experience ends up causing. This work aims to present a diagnosis, conceived from a reflexive and non-exhaustive analysis related to the Brazilian Environmental Licensing process. The results obtained through the bibliographic review underscore the importance of investing in the Brazilian environmental sector in bodies within the jurisdiction of the municipalities, so that it can continue to develop in a perspective of effective optimization of licensing processes; the need to provide spaces for dialogue between the economic and environmental sectors, so that they allow themselves to recognize the role of both instances in order to understand the unique relevance of each sphere; monitoring compliance with the conditions and restrictions imposed by the licensing process in order to legitimize it as an environmental management tool. Thus, the diagnosis linked to Environmental Licensing allows to characterize it as an idealizing tool for sustainable mechanisms, in line with its implementation in the Brazilian scenario.
